Terms and Conditions

  1. The Mentos- Free Experience promotion (“Promotion”) is conducted by Stuart Alexander & Co Pty Ltd, ABN 43 000 058 67, Level 3, 1 Small St, Ultimo NSW, 2000 (“Promoter”).
  2. The promotion is administered by TLC Marketing Worldwide Asia Pacific Pty Ltd, ABN 75 622 802 180, Level 13, 333 George St, Sydney 2000 Australia (“TLC”).
  3. Information on how to claim a reward forms part of these Terms and Conditions and participation in the Promotion is deemed acceptance of these Terms and Conditions.
  4. This Promotion is open to Australian residents aged 18 and over only.
  5. Maximum one (1) free experience* per every two (2) packs of Mentos purchased in any Woolworths stores, Australia-wide.
    *An experience is (“Experience”) one free single entry with over 100 participating venues to choose from on www.mentoswin.com.au
  6. Promotion opens for purchases 12.01am AEST on 03/04/2019 and closes for purchases 11.59pm AEST on 30/04/2019 (“Purchase Period”).
  7. To qualify, customers must purchase two (2) packs of Mentos at any Woolworths during the Purchase Period (“Qualified Customers”).
  8. To claim:
        1. Qualified Customers must visit the promotional website www.mentoswin.com.au to register and upload proof of purchase (receipt) by 15/5/2019.
        2. Qualified Customers will receive an email containing their unique code to use by 28/5/19 at www.mentoswin.com.au to claim their free experience.
        3. Once the code has been entered, Qualified Customers can then search and select an experience by 28/5/19 (Reward Specific Terms and Conditions apply – see below) (Reward).
        4. Qualified Customers must complete the claim form to receive the preferred offer eVoucher. eVouchers are available for download at the time of claim and will be sent to the customers nominated email address for later download.
  9. Last possible date to claim a venue eVoucher is 28/05/2019.
  10. Last possible date to present and use an eVoucher at a participating venue is 28/08/2019.
  11. All eVouchers are valid for three (3) months from date of issue.
  12. The Promoter and TLC reserve the right to request Qualified Customers to provide proof of identity in order to claim the Reward.  Identification considered suitable for verification is at the discretion of TLC or the Promoter. In the event that a Qualified Customer cannot provide suitable proof, the Qualified Customer will forfeit the Reward in whole and no substitute will be offered.
  13. If there is a dispute as to the identity of a customer or the validity of a customer’s claim, TLC reserves the right, in its sole discretion, to determine the identity or validity of the claimant.
  14. The Promoter and TLC’s decision in relation to all aspects of this Promotion is final and no correspondence will be entered into.
  15. Incomprehensible, indecipherable and incomplete entries may at TLC’s discretion be deemed invalid and not eligible for Reward.
  16. The Reward is subject to availability. If the Reward is unavailable, for whatever reason, TLC reserves the right to substitute the Reward for a Reward of equal or greater value and/or specification, subject to any written directions from a regulatory authority.
  17. The Reward is personal to each Qualified Customer, and cannot be exchanged, transferred, shared or assigned in any manner. Rewards cannot be used or redeemed in conjunction with any other Promotion.
  18. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of TLC or the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, TLC or the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
  19. Promotion is available online only and therefore access to the internet is required to participate in this Promotion. Any cost associated with accessing the promotional website is the claimant’s responsibility and is dependent on the Internet service provider used.
  20. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter or TLC (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s or TLC’s control); (b) any theft, unauthorized access or third party interference; (c) any claim or reward claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter or TLC) due to any reason beyond the reasonable control of the Promoter or TLC; (d) any variation in reward value to that stated in these Terms and Conditions; (e) any tax liability incurred by a customer or claimant; or (f) a Reward.
  21. The Promoter (including its directors, officers, employees and agents) and TLC reserve the right, at any time, to verify the validity of claims and the Qualified Customer (including a Qualified Customer’s identity, age and place of residence) and reserve the right, in their discretion, to disqualify any individuals who they have reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter’s and TLC’s discretion. The Promoter’s and TLC’s legal rights to recover damages or other compensation from such an offender are reserved.
  22. Personal information (PI) is being collected by TLC in order to conduct this promotion. For this purpose, TLC may disclose PI to third parties, including but not limited to agents, contractors, service providers, suppliers and, as required, to regulatory authorities. Participation is conditional on providing this PI. TLC will use and handle personal information as set out in its Privacy Policy, which can be viewed at http://www.tlcmarketing.com/uk/Legal#au. In accordance with the TLC’s Privacy Policy, if the Qualified Customer is given the option to and opts in, TLC and its selected partners may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. TLC may disclose personal information to entities outside of Australia (particularly in the United Kingdom). The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.mentos.com.au/terms-use Each Privacy Policy also contains information about how Qualified Customers may opt out, access, update or correct their PI, how Qualified Customers may complain about the treatment of their PI, and how those complaints will be dealt with. All Qualified Customers information remains the property of the TLC and/or the Promoter.
  23. Should a Qualified Customer’s contact details change during the Promotion, it is the Qualified Customer’s responsibility to notify TLC. A request to access or modify any information provided in claim/entry should be directed to TLC.
  24. The terms of the Reward are as stated in these Terms & Conditions and no other representations (written or oral) shall apply. Nothing in these terms affects any statutory rights a Qualified Customer may have including under the Australian Consumer Law.
  25.   26. Specific terms and conditions apply to the Rewards set out below and are to be read in conjunction with the Mentos-Free Experience Terms and Conditions above.
  27. It is a condition of accepting the Reward that the Qualified Customer must comply with all the conditions of use of the Reward and the Reward supplier’s requirements.

Schedule 1

Free Single Days out Entry

  1. Each experience voucher entitles the customer to claim one (1) free admission to the participating venue of their choice (as set out on the promotional website mentoswin.com.au (Free Days out Pass) subject to the terms stated here.
  2. eVouchers must be printed and surrendered or shown on a Customer’s mobile phone either via the link or a screen shot at the selected venue on the day to ensure the customer receives the Free experience selected. ID may be required when presenting the eVoucher as proof of identity.
  3. Customers can use the unique code on the Promotional Website to claim an experience eVoucher. Limit of one (1) eVoucher per person, per venue, per day.
  4. Only one (1) eVoucher may be used per venue. Participating venues will not allow multiple members of a group to redeem their eVouchers at the same time. Please contact the venue in advance of redemption to avoid disappointment.
  5. eVouchers are valid for one (1) use at a participating venue until the expiry date printed on the eVoucher. Additional restrictions on validity, age and height restrictions may apply – please check with the chosen participating venue.
  6. eVouchers can only be used at the chosen venue (as printed on the Voucher).
  7. eVoucher must be presented at a participating venue and possession of an eVoucher does not provide the voucher bearer to any preferential treatment.
  8. It is the responsibility of the customers to use their eVoucher by the specified expiry date. The eVoucher is issued with the understanding that it will not be extended or replaced.
  9. Use of eVoucher is subject to availability at participating venues and their use may be limited during public and school holidays and other peak periods.
  10. eVouchers cannot be used in conjunction with any other voucher or special offer.
  11. The Promoter, TLC, its respective agents and distributors are not liable for lost, stolen or damaged eVouchers.
  12. The Promoter, TLC, its respective agents and distributors will not be responsible or liable to compensate the purchaser or other bearer, or accept any liability for any personal loss or injury occurring at the participating venue.
  13. The Promoter, TLC, its respective agents and distributors do not make any contractual promise or representation regarding the quality and/or availability of the services offered by the venues and cannot be held liable for any resulting personal loss or damage. Any statutory rights the customers may have remain unaffected.
  14. Any disputes between customers pertaining to the use of the eVouchers are strictly between the customers and the participating venue.
  15. The experiences are subject to promotional availability. The Promoter or TLC reserve the right to withdraw or substitute experiences and/or eVouchers with another offer of equal or greater value, for example, if a venue closes, a replacement eVoucher may be issued for another venue.
  16. All customers taking advantage of the Free Days out Pass do so, on complete acceptance of these terms and conditions.
